These Terms govern your use of the Bar Last Call app and platform ("the Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
Bar Last Call is a technology platform that lets you place drink orders with participating bars. Bar Last Call does not sell, serve, or furnish alcohol. The participating bar is the seller of record and is solely responsible for verifying identification, deciding whether to serve, refusing or limiting service, and complying with all applicable liquor-license and alcohol-service laws.
You must be at least 21 years old to use the Service. By using it, you confirm you meet that requirement. Confirming your age in the app does not replace identity verification — a bartender will still physically check your ID, and the bar may refuse or cancel any order at its discretion.
You sign in by verifying your mobile number with a one-time code. You're responsible for the activity on your account and for providing accurate information. Don't use someone else's number or impersonate anyone.
By verifying your mobile number you consent to receive a login code and transactional texts (order-ready, pickup, last-call) from Bar Last Call. Message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. See our Privacy Policy for details.
Orders you place through the Service are prepared and fulfilled by the participating bar. Pricing and availability are set by the bar. Payments are processed securely through our third-party payment provider; refunds or disputes for completed orders are handled by the participating bar — contact the bar, or us at Donnovanmiller@gmail.com, for help.
The Service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. Bar Last Call is not responsible for the acts or omissions of any participating bar, including service decisions, over-service, food or beverage quality, or compliance with alcohol laws — those are the bar's responsibility. We don't guarantee that messages will always be delivered or delivered on time, as delivery depends on carriers and devices outside our control.
To the fullest extent permitted by law, Bar Last Call will not be liable for indirect, incidental, special, or consequential damages, or for any matter relating to the sale or service of alcohol by a participating bar.
You agree to indemnify and hold Bar Last Call harmless from claims arising out of your misuse of the Service or your violation of these Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. [Confirm the right jurisdiction for your business.]
We may update these Terms from time to time. We'll revise the "Last updated" date above when we do; continued use means you accept the updated Terms.
